Public Act 94-1067 called for those doing business with the State to consider hiring qualified veterans and certain ex-offenders. The law provides tax credits for businesses that add such workers and for the Department of Central Management Services (CMS) to report annually on this matter.
An encouragement to hire both ex-offenders and qualified veterans is included in the standard bid documents that reads as follows:
1.16 EMPLOYMENT TAX CREDIT: Vendors who hire qualified veterans and certain ex-offenders may be eligible for tax credits. Please contact the Illinois Department of Revenue for information about tax credits. If you received this tax credit, you must report to the Department of Central Management Services the number of individuals hired for whom you received tax credits.
Further, in response to the legislative goals, this language has been added to the standard terms and conditions of all contracts that agencies use:
2.9.2 Upon request and on forms provided by Agency, Vendor shall report the number of qualified veterans and certain ex-offenders hired during Vendor's last completed fiscal year. Vendor may be entitled to employment tax credit for hiring individuals in those groups (PA 94-1067).
To report on the hiring of either ex-offenders or veterans by vendors doing business with the State of Illinois, we ask for the following information to be reported to later than December 16, 2017.
Reporting is only required if your business hired veterans or ex-offenders during the fiscal year which ended June 30, 2017.

The amount of employment tax credit earned for the hiring of these groups of people in Illinois during the past year.
Please complete this report for the twelve month period July 1, 2016 through June 30, 2017 and return by December 16, 2017. You need to respond only if hiring occurred.
For purposes of reporting, the following definitions from the law are provided:
"qualified veteran" means an Illinois resident who:
(I) was a member of the Armed Forces of the United States, a member of the Illinois National Guard, or a member of any reserve component of the Armed Forces of the United States;
(ii) served on active duty in connection with Operation Desert Storm, Operation Enduring Freedom, or Operation Iraqi Freedom; and
(iii) was honorably discharged.
"qualified ex-offender" means any person who:
(I) is an eligible offender, as defined under Section 5-5.5-5 of the Unified Code of Corrections;
(ii) was sentenced to a period of incarceration in an Illinois adult correctional center; and
(iii) was hired by the taxpayer within one year after being released from an Illinois adult correctional center.
