|The Illinois Tollway giving notice to enter into a sole source contract to exercise the first one-year renewal option with The Nature Conservancy (TNC) for the services of providing 14.7 acres of compensatory wetland mitigation along with assisting the Tollway in the translocation of the State endangered Sisyrinchium montanum (Mountain blue-eyed grass). The referenced services are items that are required per the National Environmental Policy Act (NEPA) review process for the I-294/I-57 interchange project.|
This is a pre-negotiated sole source renewal for a term of 12 months. One renewal option exists after this renewal option is exercised. Although the value of the upcoming renewal term is $755,538.40, there is no increase to the upper limit of the contract needed at this time to accommodate the upcoming year. No additional spend is being requested.
A hearing is scheduled for 2:00 p.m. on Wednesday, April 11, 2018 at the Stratton Office Building, 401 S. Spring St., Room 511, Springfield, IL 62706. Interested parties wishing to request a hearing or submit comments must do so in writing and submit their request to the notice contact. If a public hearing is requested, the purchasing agency shall present testimony justifying the procurement method. Any interested party may present testimony for or against the sole source determination as described in this notice. The purpose of the hearing will be to receive information from the public regarding whether a sole source award is appropriate and in accordance with the Illinois Procurement Code. Formal rules of evidence will not apply. Hearings may be recorded in order to aid in the production of minutes. Parties may submit written comments in lieu of attending the hearing. Written comments will be afforded the same weight as oral comments received at the hearing.
After consideration of the testimony, the Chief Procurement Officer may approve the purchasing agency's request to contract by the sole source procurement method.

|Sole Source Only Justification:||The I-294/I-57 Interchange project was established as a joint Illinois Department of Transportation ("IDOT")/Tollway project with IDOT being the lead agency. IDOT, as part of all projects that receive federal funding, must follow the National Environmental Policy Act ("NEPA") process by conducting an Environmental Assessment ("EA”). Based on the results of the EA that was conducted per the NEPA process in conjunction with the United States Army Corps of Engineers, United States Fish and Wildlife Service, United States Environmental Protection Agency, Federal Highway Administration, Illinois Department of Natural Resources, Illinois Environment al Protection Agency, Illinois Historic Preservation Agency, Illinois Department of Agriculture, along with the Tollway and IDOT, a Finding of No Significant Impact ("FONSI")was issued noting that there would be 4.3 acres of unavoidable isolated wetland impacts along with three populations of the state-endangered Mountain blue-eyed grass that required relocating to avoid impacting the |
State listed species. The noted populations have been translocated on to the Indian Boundary Prairies ("IBP") as the area was determined to be the most suitable new habitat for the species .
Thus, this renewal of one year with no additional cost will assist the Tollway in ensuring the vitality of the species to avoid a 'Take' of a state listed species. Additionally, the FONSI notes that mitigation for the isolated wetland impacts will be conducted on -site at the IBP, a Dedicated Nature Preserve, and will be coordinated through The Nature Conservancy ("TNC").
