|Notice: Request for State Suppliers’ Report on the Hiring of Veterans and Ex-Offenders |
Public Act 94-1067 called for those doing business with the State to consider hiring qualified veterans and certain ex-offenders. The law provided for tax credits for businesses expanding its workforce this way and for CMS to report annually on this matter.
In the past, CMS responded to the law in 2006 to incorporate an encouragement to hire both ex-offenders and qualified veterans within its standard bid documents that reads as follows:
1.16 EMPLOYMENT TAX CREDIT: Vendors who hire qualified veterans and certain ex-offenders may be eligible for tax credits. Please contact the Illinois Dept. of Revenue (312-814-3215) for information about tax credits. If you receive this tax credit you must report to the Dept. of Central Management Services the number of individuals hired for whom you received tax credits. You must submit this information by August 31 of each year covering the previous 12 months (July–June) (PA 94-1067; 30 ILCS 500/45-67 and 45-70).
Further, in response to the legislative goals, CMS incorporated into all of its contracts and in the standard terms and conditions of the form contract for state agencies use the following provision:
2.9.2 Upon request and on forms provided by Agency, Vendor shall report the number of qualified veterans and certain ex-offenders hired during Vendor’s last completed fiscal year. Vendor may be entitled to employment tax credit for hiring individuals in those groups (PA 94-1067).
In an effort to report on the progress of hiring of either ex-offenders or veterans by vendors doing business with the State of Illinois; we ask for the following information to be reported no later than November 19, 2009.

The amount of employment tax credits earned for the hiring of these people in Illinois during the past year:
Please complete this report for the twelve month period of July 1, 2008 through June 30, 2009 by November 19, 2009.
For purposes of reporting, the following definitions from the law are provided:
“qualified veteran" means an Illinois resident who:
(i) was a member of the Armed Forces of the United States, a member of the Illinois National Guard, or a member of any reserve component of the Armed Forces of the
(ii) served on active duty in connection with Operation Desert Storm, Operation Enduring Freedom, or Operation Iraqi Freedom; and
iii) was honorably discharged.
"qualified ex-offender" means any person who:
(1) is an eligible offender, as defined under Section 5-5.5-5 of the Unified Code of Corrections;
(2) was sentenced to a period of incarceration in an Illinois adult correctional center; and
(3) was hired by the taxpayer within one year after being released from an Illinois adult correctional center.
